What is the name of your state? California
Hello, my wife works as a civil servant for a branch of the federal government. Before she went on maturnity leave she trained her replacement to cover the job. Upon her return the person covering her leave stayed on and took half of her job responsibilites. Although my wifes pay and benifits remain the same, she is concerned decrease in job responsibilites and knows that had she had not went out on maturnity leave should would not be facing this problem. Is her employer in violation of any laws?

Actually, I don't know whether the FMLA covers federal employees. Most of the time, when congress passes employment regulations they exempt the federal gov't from compliance. (Nice, eh?) My reference materials on the FMLA don't state whether federal employees are covered, so your wife might want to check that out for future reference.

Assuming that she is, I don't really see a violation here. The law requires her to be allowed up to 12 weeks of leave and that she be reinstated to her former position (or one of similar stature) at the same pay and benefits. Despite the re-arrangement of job duties, it certainly looks like the standard has been met.
