my husband recently had to give our family dog away due to severe family problems. we loved our pet dearly and miss him. our neighbor give us the name of the breeder and everything went well.we got our pet, paid in full.
our neighbor asked how the dog was doing, so we told him we give the dog up for adoption because things got really bad for us. now three weeks later the breeder is calling leaving messages. in her last message to my husband she said that she was going to contact her lawyer because of the things she heard. my question is does she have a legal right to do this and if so on what grounds.

I live in New York on Long Island.

The breeder is in Connecticut.

My response:

You need to tell us a lot more about why the Breeder is calling you, and exactly what the Breeder is saying to you.

Was there a written and signed contract for the sale and purchase of the dog?

What does the contract say concerning your retention or non-retention of the animal?

What was the purchase price of the dog?

breeder calling

AAL,

we are going through a very bad time in our house and we are in the process of regrouping, unfortunately we no longer have our dog and i can not find his folder that contained his papers. the dog was purchased for $1,000, which was paid in full. the breeder wants to speak to my husband and he is out of town. i don't know what she heard. we took very good care of the dog. i don't know the people my husband give the to. he told me i could not go and visit. i am wondering if the people who took the dog, to our vet who in turn notified the breeder. i can't really pin point why she is calling. and like i said my neighbor also knows our circumstances were not good at home and he was the contact person for us to this breeder. she said she is going to contact her lawyer about what she heard. that was the last message she left on the answering machine. i don't know if i should speak to her now that she threaten us with a possible law suit. i do remember, it saying that the dog can be returned within 14 days if we were not satisfied. the purchase of the dog was aug. of 2000 and the dog was given up jan 2001. we were happy with him but could no longer keep him.

My response:

I'm sorry that you are having trouble in your home. I certainly hope that everything turns out okay for you.

Anyway, with regard to the dog situation, there's still not enough information for me, or anyone, to really help you. We still don't know what the contract says, or why the breeder is calling to threaten a lawsuit.

Please, when you find the contract, and you know more information about the Breeder's calls to you, let us know.

Good luck to you.

i think i found my answer

aal,

i just ran into my neighbor and as i was walking up to him he said the breeder calls him at least twice a day about the dog she sold us. he told me the breeder found out the dog was no longer with us through a groomer. the groomer found out about the dog through a nurse that found him wondering. she in turn gave the dog to another nurse who once had a dog just like my former pet. my neighbor also told me that all breeders have first right of refusal and that could be the reason she is contacting her lawyers. by the way i still can not find the folder with the papers. my husband must have filed them. i think you know what i mean. i am very sadden that this is happening. i miss him(my dog) dearly.

thank you and everyone at freeadvice.
