This question is in regard to legalities in the state of Arkansas. My brother was married in Oct. 1995 and divorced in May 2000. He passed away Jan. 13, 2001. Into this marriage he brought furniture, an appliance, personal tools, and a storage building. He had removed other personal belongings soon after the divorce, but had not returned for the above stated items. Now that he is gone and unable to retrieve the personal items, what if any, legal right does the family (or his only child) have in trying to obtain these items? As stated above, these were not items purchased as a married couple, but family and personal possessions brought into the marriage.
