We have been "renting" from my brother in law for three years now, we have had a contract for two of those years but have always paid by check to track the rental expenses. The rent is actually the cost of the land taxes. My brother in law decided the day after Christmas to put the house on the market, for numerous stupid reasons. The house is very old, was in horrible shape when we got it (unlivable) we fixed it up and now he wants to sell it. My main question is, with two kids aged 6 and 1, what sort of eviction notice does he have to give us, especially in the winter months. We are already living on a fixed income and cannot afford to pay more rent, but it would be nice to not come home to a note saying "you have five days to get out". Please reply soon as I don't know if they are planning to evict us before the house sells or not.

Senior Member
Read your L/T laws. L cannot evict you in 5 days. Children and their ages and your fixed income is of no consequence. You still can be evicted upon proper notice by L.

I was under the impression that Wisconsin law reads that a landlord cannot evict a tenant with children without at least a 30-90 day notice, especially in winter time. I am on disability and cannot work, so it is especially hard for us to find a place within our price range. What exactly is your definition of the landlord's notice?
