father did not show up for birthday party

What is the name of your state? nm

My childs birthday was a couple of weeks ago. I normally have it at my moms house but because my ex does not feel very comfortable with my parents I had it at my house instead. He later told me that he would not be able to make it because he did not want to see my parents. (I invited him, his wife, and her child). None showed up. He did not call her for Thanksgiving either. He did try calling on our childs birthday but did not get message till few days later. (child got a hold of phone and lost it). What are your thoughts or comments. Could he use anthying against me in court if we ended up there or could I? just want to know his rights and mine. thanks

I can't see anything that could be used against you unless your court orders specified that the child was supposed to be with him that day. You invited him and he chose not to attend. One missed phone message isn't a disaster either. However I wouldn't recommend that becoming a pattern.

Thanks I feel better. This is the first time I have not returned a phone call right away or the next day if he calls late. I will not make this a habit. My daughter just lost my phone and it was not charged so it died. His mother is the one who finally found it but she lives an hour away and could not get it to me till the day after her actual party. I then called him for the party to allow him to talk to our child but i got answering machine and left a message. Still have not heard anything out of him its been a week.
