Ok this may be a little long and I am sorry. My friend is in a mess. His wife left him and their 6 kids. Left to go be with other men.

She came in the marriage with 3 he came into it with 2 then the had 1 together, He adopted her 3 she did not adopt his 2. He thinks that she can take all 6 kids go to a battered womans shelter and get custody of all 6 even his 2. Because she is his wife.

No he does not beat her or the kids. He said she can do this because she use to be a para-legal and can work around the law.

My question is can she do this and get custody of his 2 kids that are not hers just because she is his wife.

He thinks that if she did this he would have to prove he is not violent. Doesn't she have to prove that he is?

If she did take off with his 2 kids without his permission could he get her on kidnapping charges?

Neither one want to get a divorce because they do not want to put the child support on the others head. Which will not last long my friend will soon open his eyes hopefully. He is the only one paying for these 6 kids and still giving her money. It's gonna get ugly it always does

If she did not adopt his children then she has no rights of any kind where his children are concerned. Of course, as the mother of the other 4, she does have full rights there....just as he does.
