my father was in an accident on a ranch with an uninsured farm vehicle. they took him to the emergency room and found he had a cracked bone in his spine. well he fought the owners and doctors and they said since he had prior work comp realted issues with his back they werent gona give him nothing. the doctors said there was nothing wrong with him and continued to pump him with pain killers everytime he complained about the pain and sleepless nights. more fighting and the same story they dont wana pay and the work comp doctor says theres nothing wrong with him. i tell him to get a second opnion. and guess what (a few months had passed at this point) they come to find out he has 3 broken ribs 1 of which is completely cracked in half and possibly could account for the reason hes's been having chest pain. the doctor tells him hes lucky that rib hasnt punctured his lung or heart. hes summoned to court once again and presents all the findings but they of course say he received those injurys after the fact. the judges didnt help at all and only gave him about 30,000 dollars for 2 broken ribs,1 completely cracked rib which could possibly still puncture a lung or his heart if he were to get in an accident and his broken bone in his spine. im assuming theres nothing we can do because the judge all ready told him he had to prove he had those broken ribs before but of course another curve ball the Workers Comp doctor some how missed the broken ribs kinda wierd huh the insurance doctor over looked 3 broken ribs... must be nice in the land of the filthy rich. im just looking for info on what i can or cant do even if we dont get compensated at least so we know what to do next time. something like this happens to someone we know

$30,000 for two broken ribs and you don't think that's enough?!!! I never heard of such a ridiculously large award for two broken ribs! Surely, that includes payment for medical bills and lost wages. Still--$30,000 for two broken ribs?!

uhm did you not bother to read the whole post or did you just skim to the extact part that says 2 broken ribs then stopped ? please read just 1 senctence past the part about the broken ribs and you will see i added another completely broken rib and the broken bone in his SPINE. and no 30 thousand is not enough when the surgery to fix THE BROKEN RIB ALONE is about that much . what about his back ? he gets nothing ? correction on my part the first 2 ribs were cracked and the 3rd rib is broken in 2 pieces.

I read the whole thing and I remain astonished that you do not find your father's award to be more than sufficient.

A cracked vertebrae is not, in and of itself, that big of a deal. If there is no spinal cord compression or no bone fragment that may damage the spinal cord, the vertebrae will heal without causing residual problems.

sleepless nights ...pain...suffering for god knows how long...you cant even make your bed because of the pain. and all there doing is fixing 1 of 3 damaged ribs. my father is not looking for a free ride. he clearly told them he just wanted them to pay for the surgery. they wont do it.. they know it will cost more then 30,000 dollars.. i wouldnt be here if his suffering was gona heal up like a damned paper cut. please i have better things to do then to worry about something thats gona heal over night. its been a year for your information and hes still in a great amount of pain to the point everyday activities like sitting straight or quickly getting into a vehicle are hard without getting shooting pains thoughtout your back and chest down to your lower legs. i only wish something like this doesnt happen to one of your loved ones and the insurance companys just spit in your face and no where near compensate for the damage done.

i know it doesnt make sence. i would have figure the same thing. My dad has been in 2 work comp cases in california. Now this being his 3rd case in colorado. i understand we might not be able to get more money. At least we'd like to report malpractice or something similar becuase they totally looked over 3 broken ribs. The second Doctor he saw said theres no way they could have missed seeing the broken ribs ... from that alone i knew they purpously misdiagnosed him.

Broken ribs

Broken ribs do not require surgery. They are left to heal on their own. In fact after 3 months one would expect the ribs to have healed. Certainly he should have been given a chest binder to wear while they healed. I imagine they did a chest x-ray when he first went to the ER. That is all the proof you need to show the injuries were caused by the accident. If the did an x-ray that revealed a spinal fracture they certainly did a chest x-ray. Your father is no more likely to puncture a lung now than he was before his injury.

In addition, I don't know who told you they wanted to operate on a rib to fix pain shooting down his legs, but if that was said it is nonsense. He needs to see a spine surgeon and pain management specialist for evaluation.
