father's will

my brother and his wife took my father before he died to have me written out of his will. the attorney said that he couldn't do that. the will that was made has my brother as his personal representitive. the will states that his personal property (except for cash on hand or on deposit) are to be split between my brother and i..........at his absolute descretion in as nearly equal shares as practicable.
it also states that .if any children entitled to take under this memorandoum cannot agree on the division of property bequeathed them then my representative shall have the power to make such division and such division shall be final.
it says that any fiduciary may act without qualifying before any court or filing with any court any inventory, accounting or other report relating to the administration of my estate.

my brother and his wife kept me out of my fathers place for 4 months while they cleared almost everything he owned out of there. and also took his car.

my father recieved $125,000 from a life insurance policy when my older brother died in 2001.
he already had alzhemiers then. and still had it when his will was written 9 months before he died.

i guess my question is.............that i am screwed right ?

That all depends on what YOUR attorney tells you.

Do you have access to the original will before you were written out, or do you think the attorney would have access to the original?

Get an attorney now to review all of the facts. You ARE NOT screwed. These people's actions are suspicious and improper and illegal, especially if you can prove by medical records that he had alzheimer's on the date he signed the will.
