What is the name of your state? texas

First I am wondering if there is a form that an ex-wife can sign saying that her ex-husband does NOT owe back child spt. That he did in fact pay the child spt to her? Next if a father wants to give up his parental rights to the kids, does he still have to pay child spt? He does not owe back child spt. either?

No, YES- still pays support-

I don't know if Texas has a "form" per se but a written affidavit can go a long ways.

Also, yes... in Texas, severing of parental rights also encompasses termination of parental responibilities (ie, child support).

Do a search on the name "Boxcarbill" who is a Texas attorney that used to post on the boards. BCB has stated many times the Texas stance on TPR and child support.
 
An Affidavit of Direct Payments can be obtained through the OAG's office and should be filled out by the custodial parent. This is the detail of all monies that the custodial parent admits to receiving directly.

As for the rights/responsibilities issue...as far as I am aware, parental rights and responsibilities are 2 separate issues. You can sign away your rights (or priveleges), but can still be liable for the responsibilities (or child support), unless there is another person to adopt and take up the financial burden of the child.

The reason being that most state agencies need to be able to recoup their money should they have to support the child on welfare or medicaid at any time. And specific to Texas, this is because the State of Texas has one of the largest populations of uninsured children in the country and they absorb a significant cost when it comes to providing for uninsureds/low income families.

Since there is no accountability regarding how child support is spent, the ex wife could simply cash the checks and send new checks right back to the ex-husband. Nothing there to stop that...in fact, it will make the state think he is paying and they will leave him alone.
