Fees for Community Recreational Facility

Good day to everybody out there and thank you for taking the time to comment on my question.

I presently reside in a deed restricted community and according to the deed restrictions all residents in unit 9 (the unit i reside in) must pay a sum to the greenbrier club for the maintenance and use of the recreational facilities. This sum in the past has been $96.00 for 2 residents. Last year the fee was incresed to $150.00 for 2 residents. Neither my wife nor I use the recreational facilities nor do we ever intend to. I would like to know what options i might if any to remove our home from membership in the Community Recreational Facility, or to remove ourseles as members. It has been stated by the board for the club that the Greenbrier Club is a social club and NOT a home owners association. As such membership in my opinion should be optional and not mandatory. I would like any advice on what options I may have. If certain text from the deed restrictions is needed I will be willing to post the deed restrictions in part or in whole. AGain any help would be greatly appreciated.

You can't get rid of deed restrictions.

I don't want to get rid of the deed restrictions, but modify them, or perhaps try to find a loophole.

My response:

Sure you can. Haven't you ever heard of an eraser?

Seriously, this same argument is used concerning public schools. A little old lady is paying a certain portion of her home taxes on public schools. She wants to save money, and asks if she can have a waiver from having to pay toward the school system that she doesn't use.

It never flies.

I can understand that argument, with regards to the fees increase are there any guidelines that must be followed when increasing fees? Limits on how much they can be increased etc?

Ask whoever it is to see the governing documents on the organization.

Gee, I don't know. If I wanted to know the answer to that question, you know what I'd do?

I'd read my CC&R's or ask the people who were raising my rates to show me something giving them the authority, and how much they are allowed.

Seems logical enough. But then, I'm not you - - and I'm not known for my logic.

I'd read my CC&R's or ask the people who were raising my rates to show me something giving them the authority, and how much they are allowed.
Actually, Yote, that's what I would do also. Many times people come on this forum and ask questions that are answered in their contracts/documents. Obviously, since we are in cyberspace, we can't actually view their papers. However, we are familar with the type of documents that they have in their posession which is why we tell them to carefully read them.
