felony charge reduced?

i was charges with possession for sales(meth),possession for sales with a handgun(stolen),recieving stolen property(the handgun).the da offered my lawyer a deal,if i plead guilty to 3 felonys i would get 2 years probation,90 days home detention then after 2 years the drug charges could be dropped to misdemeanors and stolen property would be dropped. is that possible to drop drug charges like that? would i still be a felon after 2 years? this is in contra costa county,ca.

A simple possession offense can be reduced to a misdemeanor (H&S 11377) as can receiving stolen property, but not a possession for sale (H&S 11378). If you plead guilty to offenses that can be reduced with an explicit understanding that they will be reduced if you successfully complete probation, then you won't be a felon IF you successfully complete probation. This kind of deal is a trap if you do not behave on probation. If you violate your probation (not reporting, dirty test, etc.), you can be sentenced to state prison for all three felonies. Also, none of the offenses will be reduced and you will end up with three felony convictions. In other words, you cannot maintain a drug problem and benefit from this deal.
