I recently bought a new home in North Carolina. The builder of the home (one of two builders of the development)built a fence around my property(which matches all other fences in the neighborhood)as part of the contract to purchase. I just received a letter from the Homeowners Association that said that I need to remove and replace one side of the fence with a split-rail fence or help pay for the cost of landscaping the outside of one side of the fence because a neighbor has complained about the fence. Because of the configuration of the lots, the neighbor now sees my fence instead of the side of my house, and because there was no HOA's Architectural Approval, they say they are entitled to landscaping or a new fence. Since the builder built and paid for the fence, aren't they responsible for obtaining architectural approval and therefore any claims?
