What is the name of your state (only U.S. law)? Arkansas
I inherited my mom and dads place and the renter of the land 60 acres had let the fences go down so when I took it I quit renting and just been selling the hay off of it to pay the taxes. Well the one fence line is between me and my mothers sisters land and she rented her place and called and asked if the man who rented if he could redo the fences and the fence between us. Which it didnt matter to me I had no intentions of renting my land or having any animals on it as I have it for sale. She said it would increase the value of my property to have a good fence between us and the fence row cleaned out so I told her that was fine I had no problem with that then as long as he didnt leave me a mess and cleaned it all up well he redone the fence between us left a good 6 foot section out of my fence that hooked onto their fence and he drove his backhoe onto my property and left runts as deep as my knees and he pushed all the brush onto me and also the trees he cut he put on us and all the roots and all he put over on us. So I called him and he said he had no intentions of repairing that section of my fence, he never drove on my property even though i have pictures of it and that he didnt plan on cleaning it up at all and we told him we would have never gave permission to do it if we had know he was going to leave us a big mess. So then I called my Aunt and she said i could do whatever I wanted she didnt have nothing to get and she dont remember me telling her that he was not to leave a mess and that I was really suppose to pay for half the cost of the fence. Where do I stand legally? I have my place for sale and they have left something that is going to cost me quite a bit to clean up. I cant really afford an attorney or afford to clean it up I am medically disabled and still fighting disability. I need some advice cause its a bad mess they left me.
