Fence/Property Dispute

my neighbor in washington state has put a fence between his property and mine however, he has put it 3 inches onto his property leaving 3 inches of his property in my backyard. he is not allowing me to maintain his 3 inches of property or to stain the side of his fence that faces us. do i have any recourse or do i just have to look at weeds in my backyard and an unmaintained fence?
