i am a home owner in northern californa. my fence is over forty years old and 1/3 of it is laying on the ground. all i ask for is half cost of materials to build the fence, my family will do the labor. the owner behind me rents the place and refuses to pay for any of it. he owns lots of property and around here is considered a slum lord. what are my options--by law is he obligated to give me half the cost? can i take him to small claims court? ---s.h.

If it is your fence as you describe in your post, you pay 100% of the cost. The neighbor, even if a slumlord, is not liable to pay for your fence.

sorry, it is our fence. it divides the two properties. i pay for 100%?
