I need your help

Can I appeal a DA 268/ flag for failing an academic test (no reference in AR 600-8-2 or AR 350-1)? I haven't seen actual 268 but I got a message from Army Personnel Database saying I am flagged. What is the appeal/rebuttal procedure?

Can I have a military or civilian lawyer present during the counseling session with the CO or a rater?
