fictituos sexual harrasement

I think someone wrote a sexual harrasement complaint after cohersed by his department manager and another manager advise hm to do so. THe story is we used to talked about our days off escapades and we were to explicit in the details. one of our discussions the guy went to one of the managers and told her what I told him about my weekend. She said that was sexual harrasement and contact his manager then his manager told the guy to fille a statement. Thast was monday 3/26 and today i am still waitring for HR to call me. THe problem is now I got all depressed cause this problem and not feelinig real good about the topic,. Is possible to sue those people for mental anguish and emotional distress and is possible thast the conversations I had with the guy could turn in sexual harrasement?? it was a balance un the conversations and is turn is his word against mine. please advise ASAP

Today 4 days after the rumor of complaint started I has a meeting with my boss . Thanks for your adivce and I let you know the outcome.

3/30/07 Today after having a meeting with my hr director and the agm they told me that wait until monday to know the outcome of the investigation. I was told troday trhat the other guy was saying things around about gthe complaint and rhat i was involved in it. it is confidential after a complaint is file or he can ell around. Also I found out today that he was in "thin ice" one more write up and he would be fired. Now I am thinking he used me ias a pawn to retain his job. Do I need to twell my HR firector about what he is sahying around?? 'Cause now my reputation is on the line/

It really depends on what was said. It is always advisable to not discuss sex or your sex life at work for the reasons you cite- someone can get offended and it can become a sexual harassment claim.

You can not sue for mental anquish, especially because it sounds like you did what you are accused of doing- discussing your private life at work. HR is most likely conducting an investigation by talking to others at work about any such disucssions you may have had with them.

You would be very well advised to keep your personal business and tales of your weekend escapades private in the future.
