MS. My son was jumped at school and got a broken nose. The kid or his parents filed charges against my son 3 days later. I've missed work, my son has missed school, and I've got a court date coming up, which means more missed work/school. What options do I have in handling this and the bogus charges brought against my son?

At this point you hire an attorney to defend your son.

Understand that it is likely your son's interpretation that he was jumped. The facts might tell another tale.

Unless you can show that the other party or parties made a false report knowing the information they provided was false, these are not "bogus" charges, they are real allegations and must be addressed as such at least until an attorney can get them dismissed or make a deal.

I guess I should've gave more details. This incident happened at school. The entire thing is on camera, and I have the statements of both the principles, a teacher, and administrator who were all standing just a few feet away. The kid had no concern for authority and it seems his parents aren't only condoning his behavior, but encouraging it. I can't afford an attorney, but I think this kid should be punished. He was suspended for 5 days, but his parents filed the charges while he was suspended.

your son is entitled to have a court appointed attorney if you cannot afford one.

I don't suggest you try to do anything on your own.

just to be clear, the parents cannot file charges, the DA does that if they feel the case has warrant. the other kids parents just made a complaint, that was substantiated by detectives, and pursued by the DA.
