I recently purchased a vehicle and agreed upon the purchase price and finance terms. I did not receive payment info in a timely fashion so I contacted the dealer. They told me it was probably just backed up at the financial institution, don't worry. A few days ago I received a call from the dealer accusing me of getting a free car, defaming my character, and threatening to repo the car if I did not bring two payments to them. They claimed the finance company held up the paperwork due to an error. I later found out that the dealer held the contract until August after the deal was closed early June. The finance company wanted an explanantion of why the contract was late and wanted the two months payments. The dealer has since offered to re-write the contract, but that will increase my finance terms. What legal recorse do I have? If I make the payments, can I sue the dealer for defaming my character, lying to me, threatening me, and causing mental distress? Please help!

I didn't see a state listed and I'm not an attorney, but here goes:

The day you "bought" the car you should have received copies of everything you signed at the dealership. My suggestion would be to send copies of ALL the paperwork you have to the finance company along with a letter stating that you did the paperwork in good faith, expecting the dealership to send in the originals, and when you didn't receive the payment info, YOU made the effort to find out why. Tell the finance company you have tried to get this fixed and the dealership made excuses. Explain to the finance company you would like the car, but only under the ORIGINAL contract YOU signed in June. Tell them you will make the payments if they will honor the original contract. CC everything to the local BBB and the car manufacturer (Honda, Ford, etc) at the address listed in the owner's manual for customer service.
