Filing an Answer/Waiver while one party is overseas

Me and my spouse have agreed on a simple uncontested divorce.
I have provided him with the paperwork and we are to the point where he needs to file an answer or waiver. We've already agreed to the divorce decree but he has no way to come back if needed for court but doesn't want to give up his rights. We are not sure which to do.

1) On either it says that that they need to be filed with the court. Whichever he chooses, can I file it form him (if he mails it to me) or does he need to file it himself (Or find a lawyer to do so)?
2) If he does the waiver will a overseas Notary work?
3) If he does the answer, will he need to be in court even if he's already signed the Final Decree?What is the name of your state (only U.S. law)?
