We have to respond to a OSC for Modification where the custodial parent is currently in contempt of court. Can we attach motions to the response to request 1) contempt of court, 2) vexatious litigant, and 3) restraining order. We have to fly from HI to CA for the scheduled hearing and want to incorporate all the issues at one time.

Any thoughts?

My response:

Yes, of course. Use California form number 1285.40 (Responsive Declaration). Remember, you must file and serve your response, with any new matters, no later than 2 court days prior to the hearing.
