I am an American who married a British citizen in a 1995 ceremony in New York, and moved to England to live with him. However, following incompatibility and abusive behavior, I returned to New York after 10 months. Although we are friendly at a 3,000 mile distance, repeated attempts at full reconciliation have failed, and there are no children. My husband has been given an early retirement package for the the fall which will result in a lower income if he does not find another job. As I do not intend to live with him again, I assume it is important to arrange a divorce before his income drops. We do not have a legal separation agreement. My solicitor in England is ready to file there, but I am now advised that it would be more advantageous to file in New York.

Will it worsen my financial settlement if I file after his income is reduced? Would it be better to file in New York, and I eligible to do so even though we were never domiciled here? Are there any steps I can take at this point to protect my interests in this situation?

I would be very grateful for any advice that could be provided. Thank you.
