What is the name of your state? NY

my fiance' has been here in the US for 10 months now,her I-94 has expired ,we are to be married next month.I would like to know, how soon can i file for her after we are married and how to go about doing so ?
will they be any problems?

On what visa did your fiance first enter the US? Did he enter the US legally?
