I recently filed my own divorce in the state of Texas ten days ago. Spouse was send a copy registered mail. Upon my return home, i discovered that i had not signed the bottom line of the petition for a divorce, should i be conserned about this, perhaps file another copy, sending another copy to my spouse, or not? I dont want to get into court two months from now, only to find out i have to serve him again! Thank you!

My response:

I must presume that the original Petition that you filed with the court was signed, otherwise the clerk would have rejected the same. The copy that was served on your husband is what is called a "conformed" copy; i.e., it bears a court filing stamp at the top. As such, the conformed copy does not need to be signed. The only one that counts is the signed Petition that was filed with the court.

If this is the case, you're going to be just fine.

Thanks again for your quick response! And in answer to the question, on the form, it has two places for signatures, one which is located under the respectfully submitted, (of which i printed and signed my name) and another one after the long capitalized statement about policy of the state of Texas, this one, is the one i forgot to sign. I think ill be fine, thank you again!
