Filing For Unemployment

What is the name of your state? FL

If filing for unemployment, will the Child Support come automatically out of those checks? (already has CS taken out of his checks weekly).

Normally, yes, if it doesn't slip through the cracks.

Okay, thanks. He wants to make sure it does get put through if this happens. I'll just have him make sure he mentions that it was coming out of his paycheck before hand.

If and when he approved for unemployment , he should file a petition to modify child support amount .

Little update.. it has been confirmed that he has been "let go" from his job. The owner of where he worked said he will not fight unemployment, he understands that he needs it. Don't really want to go into further detail because this is just ridiculous what's going on... but anyways, speaking of modification of CS-- his ex asked for a modification about a month or two ago (that's when I first found this site... was asking for help). We filed a response but the financial affadavit had all of his now OLD job's information on it. Since there's a petition out for modification already, do we just let that go through to the judge and update the information then? Orrrr...? Thanks so much again.

The CS will be automatically deducted from the unemplyment, however, that usually takes 2 to 3 weeks. So, he'll need to make the payments himself until they are deducted.

Since his info is now different, he should file and serve an amended financial affidavit with all of the new info on it. He needs to do this BEFORE the modification is heard, if he doesn't the CS will be based on the incorrect income.
