Hello to all and a special hello to Beth:

We have a final payroll check to distribute tomorrow to an employee. On the front of the check we have the text Final Payroll - pays through July 15, 2003. On the back of the check we wanted to place the following:

"by endorsing & cashing this check you hereby release _______ of any or all claims present & future"

1st Question: The underline is our company, does this phrasing sound proper?

We released her on July 1, so had no contract and we decided to pay her until the 15th.

Her husband who was EVP resigned (who had a contract) on the 27th of June, walked off an executive meeting on this day and verbally annouced his resignation. He followed up with a resignation letter on Monday June 30, however it had some other areas that offered different scenarios ("Without prejudice" section offering settlement of his severance package, since his contract had a 6 mo. payout if he resigned. However, In Germany the owner then sent him an e-mail and certified document saying that he wasn't accepting any scenario and that he was letting him go for cause and documentented various pages as to why. Real Messy and sometimes as Controller I get in the middle. And as always I want to do what is legally right if it is in our favor or not. Any thoughts???

Yes. Skip the statement on the back of the check. Unless you've executed a well prepared and thorough waiver of rights that includes all the necessary legal mumbo-jumbo (that's 2 - 3 pages worth), then this is pointless. If you want to give her two weeks pay as a parting gift, that's very generous on your part but that's all that it is.

Regarding the mess with the EVP, you'll need to see a lawyer on that one. It's a contract dispute and you'll need expert legal help.

Thanks for your advice Beth. We are in the middle of contacting an attorney so we are on the right track. The owners have a contact on Atlanta, but we trying to deal with a local attorney in Tampa, FL . Thanks again. you are the best!!!!
