finally got a job!!

What is the name of your state? Vt. I went into court March 13th, for contempt of not paying child support. Not to make this too long...I have been searching diligently for over a year, even to mcdonalds..no luck. I was on unemployment at the time. I went into business and paid for 2 months of child support, but that fell through. Family could not work together. Anyways, I also have been ill, and am scheduled for major surgery march 28th. My new employer knows. They are great about it. So, the judge from the march 13th wants me back in 30 days with proof of my surgery, doctor notes, and so on. Even with my surgery paperwork, Its like he didnt believe me. He said I was looking at jail time. I was shocked since in the last 5 years only missed a total of six months of paying due to my unemployment. I am going in for surgery, will be out of work for a total of 2 weeks to recoup, but now I have a job. I don't want to go to jail, and its not like I have not been searching. I also have two small kids at home. If he puts me in jail as a punishment, I will lose my job. I am scared since the office of child support people are such jerks, and dont give a crap. Its like this lawyer for ocs gets off on punishing ncp's for getting behind. Will me working now help this from not happening?? I got in arrarages of over 7,000.00 due to months missed and surcharges added on. Thanks, Faith

As long as you have a job, are paying something, or have very good medical documentation it's very doubtful that you will be jailed. Just make sure to appear at the next hearing with all your documentation and proof of payments recently made.

All Judges act like they do not believe a NCP in a contempt hearing, even when they are telling the truth and produce documented proof of income, assets (or lack thereof), or medical problems. However, they usually do follow the laws in the contempt decisions, just like in your case. The Judge did NOT send you to jail simply because legally he couldn't when you produced proof of your health problems. To give an example, in my husband's contempt hearing 7 yrs ago the Judge stated that she did not believe that he was disclosing all income earned and that she felt that he had undisclosed assets (neither were true) however, when she set the purge amount it was based on what he proved his income was. I have no doubt that she wished she could have set it higher but legally she couldn't base the amount on what SHE thought, only on what was proven in court. So, when you run across a Judge's attitude like that ignore it and be thankful that the Judge at least followed the law.;)
