I have an aunt who isn’t doing well in California (I live in Massachusetts). I’m trying to find out if she has any legal documentation like a Will, Power of Attorney, Health Proxy ect.

I am her only living relative and was tracked down by a neighbor who was concerned of her well being.

No one seem to know if she had a personal attorney and she is in no condition to answer these questions (Alzheimer’s)

I was wondering if when you do any legal documentation if you have to record such information such as who holds these documents.

I want to do what’s best for her but I don’t know how to go about locating this information. If there is any to locate.

Thanks

If this lady has the beginning or advanced stages of Alzheimer's, it would seem that she is probably in no condition to be taking care of herself. Ask the neighbor if she knows of anyone who has been coming over to the lady's house to help her. If there is no one, then you should think of helping out by trying to get a guardian or conservator named to help her.

Actually the lady that contacted me is taking care of her along with a live in housekeeper but is getting to be a bit much for them.

The plan is to move her back to the East Coast to spend her last days with the family she does have.

She is financially self-supportive for now…but I didn’t know what type of legal right I had to step in. there isn’t really anyone in charge of her affairs yet. They are looking at me to do this. She does have a house and some investments.

I just was hoping to find some type of legal documentation that may already be in place (as suggested a long time ago) giving me the permission or to list someone else.

I have to do as much as I can from back here before I take a trip out there.

So talk to a family law attorney in California (in the same city or county that your aunt lives in) to find out what your options are. If you are the most closely related family member, then you need to step in and do something so that the neighbor lady or anyone else does not step in and take over your aunt's financial affairs.
