What is the name of your state? arizona

We are 3 students who signed a residential lease a house in Tucson, in August. The lease stipulates that the 3 of us are signing as "jointly and severally referred to as tenant. The lease also requires us a "tenant" to have an comprehensive general liability insurance. One of us had the insurance, however, she left in December, and was replaced with another student. A fire broke in our house early december because of a litten candle. There was some fire damages to the living room, the mantle above thefireplace, and our furniture, and smoke damage to the rest of the house. We have repainted the living as best as possible, but the landlord is unhappy with it

Who is responsible to pay for the damages, the paint, etc...

ALL 3 of you are!!!!!!

Jointly and severably liable means you all share in the damages, and the landlord can go after any one of you with the Most money and force that person to pay it ALL!

This is a good lesson in being a CHEAPSKATE, by not having renters insurance you saved maybe $150 a year, but now are liable for any and all the fire damages to the apartment.


Oh,,,,,,,,, since you dont have insurance that is a violation of the lease and ALL of you can be evicted, pronto.

Pretty expensive not having insurance... HUH?

If your LL made your having renters Ins a requirement in your lease and you dont have it you need to fix that as a matter of self protection. If your LL isnt happy with the paint job sit down and talk with the LL about going to a paint store or larger hardware chain and see what they recomend you to use for primer and re paint whole unit to get rid of all smoke damage other wise you should expect that you all will be taken to court by landlord to recover excess damage moneys and any other damage related to the fire , one of you was careless with use of candle and that carelessness will cost all of you unless you sit down and correct all of the fire damage . see If you dont take action to make this right what you can expect first is no return of deposit , then your LL taking you to court for the extra damage cost , and it wont matter if there was 3 of you on lease or not because you all will be named in the summons and when it doesnt get settled what will happen is that one of you will apply for credit or sometime down the road a new place to rent and your credit can be denied or apt application turned down , so sit down with your LL and get this worked out AND if you have to ask your parents for the money to make it right .
