Yesterday, my employer was made aware that I had filled out paperwork with the hourly & wage division for paying me less than minimun wage. Today I was fired.

1. What rights do I have at this point?

2. What am I entitled to legally?

3. What can happen to my "ex" employer for firing me over this matter?

Did your employer give you a reason that you were fired? Have you done anything else that could merit a legal firing? Cause if not, that's definitely illegal and you should report it to the DOL.

He wouldn't give me a reason....

I am an exemplary employee. My attendence is great. My performance is great. Last week I recieved a letter from the Department of Human Services regarding child care stating they would only cover 75 hours over a period of 2 weeks. I, of course, work more than 75 hours every 2 weeks and went to my employer asking him to write a letter to DHS stating this. He refused. He said I do not work this many hours and it is simply not true. Well, it is!!! I work 40+ hours a week. From the time I arrive to the office to the time I get back. This is how the part fits in that I am not getting min wage every week. I am not sure how he figures his hours but I work from 8a-5p every day without breaks. (I am paid on comission...that's it).

I was pulled into the office yesterday by the owners son. He asked me what was going on with my hours. I asked if they were contacted by hourly and wage. Oops! They weren't yet so I let the cat out of the bag. He was referring to daycare. He tried figuring out why I was paid less than min wage on most weeks, but couldn't come up with an answer. He said his Dad would know more about the laws and would consult him.

His Dad was not in the office today. I'm not sure why. I left him a VERY polite note saying I needed a letter from him asap saying I work more than the hours stated on my paycheck and last week alone I worked 40.5 hrs.

Around 5:30 I got a call from my boss telling me he got my note and he would, again, not write it because it is not true and that I am "fired". He would not go in to detail why.

I work with one other girl cleaning houses. She gets paid more than I do so she does not ever get below min wage. However, we work the same hours and she can definately back up my story.

Thats a no no click the button that says find an attorney. You cant fire someone for accessing a right.
