Hello everyone. I appreciate your time in reading this and helping me get the facts straight about my ordeal. I'll include as much back info as i can regarding.
On One saturday afternoon I spoke with one of my managers regarding my currently hourly pay rate and why it was substantialy lower than others in my area of work. Upon finding out she said it wasn't a good payrate and she would discuss this with the stores general manager. I said i appreciate the help and that I merely wanted that when my review was done ( was past due ) that i was taken care of. She responded that i had nothing to worry about with that.

A certain retail establishment rolled out a new on-call computer repair service. I was chosen from one location in charlotte to handle the greensboro market which was about 1-2 hrs north of my current residence. I was offered this position with relocation, it would require an imediate move. I was un able to move right away so we negotiated that i could commute with no issues what so ever. I began my commute and for almost two months ( as my current lease was ending) I drove anywhere from 1 - 3 hours to and from work ( they're currently doing construction on the roads.
Back to the following tuesday. I was scheduled for an apoitment that would have required 4+ hours to complete the job 2 hours before my shift ended.
I went to the clients business to start the work and after an hour realized i couldn't complete the job in a timely manner and that i could give another hours work and i would need to come back to complete the service. I spoke with the client and this was fine. However the client wanted me back the very next day. Wednesday was my day off for the week as was monday. I informed them that i wouldn't be available until thursday. Now upset the customer complained. After talking with the customer for 15 minutes It was decided that I would call my dispatc ( a call center for the onsite repair technicians) and setup an apointment for my day off to take care of the customer. I called in and setup this apointment within my schedule.
Wednesday rolled around, I took care of the errands i needed to do, went home and changed into uniform to comence my drive to work. I couldn't locate my wallet. Being as i didn't know traffics current situation and i needed to get to my clients I decided i'd look for it when i got home. About 30 minutes into driving I was in the middle lane driving with the flow of traffic ( we were required to stay with traffic and not pass if we didn't have to.) When a car began driving eraticly. I decided to come around the car to the left and pass them. As I was passing them Sirens went off and i was pulled over by a North Carolina State Trooper. I was caught speeding. The trooper asked for my license, I responded that I Couldn't find my wallet ( turns out it was in my jacket in the trunk of the car : /) He ran my name through the computer a few times and found no entries. He asked if i had anything with my name that could identify who i was. I passed along my name badge ( photo) and my insurance card. He accepted this. A few minutes later he returned and asked me to step out of the car and informed me I was under arrest. We walked to his car, this is where he informed me I was driving on a suspended license. ( I was un aware of this at the time. It was for a ticket i thought i'd paid from 3 years prior). He allowed me to call one person on my cellphone, I immediately called one of my family members to inform them of what was going on. He also allowed me to lock up all the valuables in the trunk of the car and put a sticker stating that I could pick the car up for 48 hours before it would be towed. Now when i applied for the promotion A couple months earlier one of the requirements was a drivers history background check, An item i properly filled out and such. I was informed my driving record was in good standing and would be able to be insured as a driver.
Later that night i was released from the holding cell and allowed to go home having someone else drive me. Two family members arrived and we went imediately to the car. I rode in the passenger seat of the vehicle while my father drove the car back to their house so we could get things sorted.
The next morning I called and spoke with one of the managers on duty and informed of the situation and that i need to take the next couple days off. He approved and said take your time get it fixed we can work from there. I immediatly had my schedule blocked and all the customers rescheduled to another local technician.
The next night my District level manager called to discuss what was going on. I spoke with her about the ordeal and she responded that if there was anyhelp i needed just ask and she would help. I told her i need The week of to sort things out with my lawyer regarding the ticket and my driving privledges. When asked if I was going to be terminated she repsonded with no. Things happen. She stated she wanted to pickup the car and bring it to a store where the contents could be stored and to prevent the posibility of theft ( would be no different than sitting in my driveway) but i said no problem. She decided to come by the following morning ( saturday).
Saturday arrived and she came by, I re affiremd that i was give the approval for leave and she stated I was. She then asked that i turn in my company phone and laptop. She also asked for the keys to the vehicle. I asked her specificaly in the precense of another employee that had driven to my house with her if i was being fired. Yet again she said no and that even if she wanted to she didn't have the authority. She replied that I may not be able to drive for the company but i certainly wouldn't lose my job over this. I accepted. A few days passed and I called into the store to update them with what was going on. We're now about 1.5 weeks out from the ticket.
That morning I was online speaking with someone ( happened to be the employee that came with the District manager to pickup my car) when he remarked that it's too bad I was fired. Fired? This was news to me. I then imediately called the store i was based out of and was told by the GM that I was in fact fired. He stated that he had tried to contact me numerous times on my work phone and was unable to, he also stated they mailed a leter with the reasonings to my home addresse on my paychecks. At this point I Had two paychecks awaiting me at the store that needed to be sent. I Told him alright well I'd like a copy of the letter explaining and my paychecks if you could send them to me. He said no problem i'll overnight them to you today.
The next day arrived and I recieved two paychecks and no letter explaining my firing. I imediatly filed for unemployement which is where i'm today.
After three months the unemployement agency said they had lost my paperwork and were sorry for the mishap and that they'd process as soon as possible. A few weeks later i was denied unemployement because of the following reasons.
"I used a georgia license on my application for the job there for it was impossible for the company to have done a proper back ground check on driver record. Failure to comunicat with management what had happened, and failure to protect company assets."
I imediately appealed under the fact that I've only owned a N.C drivers license there for never could have applied with a georgia license ( we had to fax copys of the I D's in with our application" , that i infact notified store and district level management, and third that I have no idea what the mean by protecting company assests.
I was granted a hearing a month later via phone. That day came and the lady handeling the hearing was sick so it was pushed another month back. Here it is feb and i'm still fighting this issue.
Now when i signed up with this promotion it was a fairly new service. We were told about no D.U.I ever and that was our agreement we signed. We were informed that speeding tickets happen and that as long as we take care of them there was no recourse for such. Never was a procedure given for if you were arrested/detained with vehicle etc. I did everything in my power to protect company assests with the vehicle, and the vehicle itself was removed from my possession with a few days. I can only speculate that this is what they're referreing to as protecting company assests.
My question is Not weather I screwed up. I accept my actions for speeding and the previous ticket not being taken care of as I thought. My question though is did they have a right to fire me? Do they realy have a leg to stand against me with this un-employement hearing? I had a perfect employement record with them for previous years with no write ups. Furthermore this all happened around the time that i was pressing about my pay not being equivilent to people that worked for me. (i'm currently working on getting back driving privledges so that i can return to a job, city transport isn't available at my residence either so i'm stuck in a rock and a hard spot - no more speeding at all for me )
I'm a tad confused and i'm sure some of you probably are too.
