I was working at a gym (only 2 hours a week) as a Zumba instructor. I was told by my doctor to stop teaching at 36 weeks. I gave birth at 41 weeks and today (4 weeks later) I received a call from the gym being told that they will not be having me come back. I was not given a reason.
Is anything about this illegal?

Since you were not working enough hours to be covered by FMLA, no, it is not illegal. If they discovered while you were out for nine weeks that they could do without your 2 hours a week that you were working, there is nothing illegal about that.

They actually hired what was suppose to be a substitute for me that has now taken over my class. So it wasn't that they no longer needed my 2 hours it was that they replaced me.

Legal and understandable. There are so many zumba classes out there, I bet you will have no trouble finding another part time position when you are ready to resume working.

Doesn't change the answer. Your time off was not protected because you did not qualify for FMLA. They had no legal obligation to return you to work, regardless of why they decided they didn't need you.
