Hello I worked at a book store for about 4 months. I was fired yesterday by corporate loss and prevention. Apparently they found something in my background check. I spoke with someone in loss prevention and they told me it was either my criminal background, my credit report or this test that they had me take. The thing is they refuse to tell me specfically what got me fired. I want to know if there's anything I can do about this. I'm pretty sure it had to do with the test they had me take. I want the results of the test, is there anything illegal about what they are doing?

What kind of a test did they have you take? Did you take it at the time you 1st applied there for employment - I'm surprised it took them 4 mos. to fire you or even hire you in the 1st place.

they had me take the test after I had worked there for 90 days because I was about to receieve a key to the store. I got fired about 2 to 3 weeks after I took the test. It was a test figuring out whether or not I would steal from the store I suppose. It asked about my honesty, if I was a violent person and drug related questions. I've taken these kinds of tests before and never had any problems and I don't believe I put anything that would of gotten me fired.

Texas is an "at-will" employee state which means you can be fired at any time for just about any job related reason (except discrimination) unless you had a contract that made other provisions re firing or an employment pol. that prohibits such firings. If you believe the firing was the result of discrimination, you can contact the EEOC or consult an employment attorney. If you feel your firing was unfair but not necessarily discriminatory, you can contact an employment attorney to discuss whether you have any basis for filing a lawsuit. Be sure to discuss the matter with your former employer first though.

what about the fact the won't tell me why i've been fired, can I do something about that? They also refuse to give me the results of this test i took or the results of their background check.

They are not required to give you a reason for your termination, the results of the test, or the results of the background check.

The ONLY exception to that would be if you were being fired SOLELY because of something in a background check that was run by a third party.
