I been working for this company for 2 years and when i first got hired told them about my criminal history, on my application i told them about my Driving while intoxication. they ran a background check the other day and found no new criminal charges. can i get fired? and if i do get fired what legal action can i take?

If you told them the truth when you were hired and they didn't find anything new when they ran the background check it is highly unlikely that they would fire you. If they did, however, I don't know that you could take any legal action; unless it's a pretext for illegal discrimination your employment is at will and they don't need a reason to fire you.
