First DUI in NJ - help please

Hello everyone,

I desperately need your help. Yesterday I was charged with DWI in New Jersey. I am so much depressed and don_t know what to do_This was my first time DWI at all. The officer took me to police station and I tried to do the breath analyzer test as instructed but the officer gave me second ticket for refusal for breath test which I did not; I tried 3 times as he ordered and the test didn_t work. He gave me ticket for DUI but there is no other ticket as traffic violation for what he stopped me first place. He did not stop me for valid reason such as any kind of moving violation. Do I stand a chance to fight this back with attorney in court? I am a professional and very much concerned how DWI will affect on my job. I am scared of losing my job and will I be able to get the same kind of professional job again ? I am a pharmacist and working for a reputed pharmaceutical company.

If I lose the trial and get convicted in court; is it possible to expunge your New Jersey DUI record in the state of New Jersey. I will really appreciate your help. Thanks a bunch.

Thanks for your reply. So what do you suggest now? Should I just forget it and plead guilty? Should I go to court and give it a shot? Do they do plea bargain in such cases? Are there any jail time for first time DUI in NJ? I am just way too confused and worried about what happened. Any guidance or feedback is very much appreciated. Thanks.

You need to fight this

Even without the test results, the cop could testify that you were drunk in his opinion. I'm guessing you at least had some drinks. No, you cannot get DWIs expunged. The Judge is going to force you to get an attorney, so I suggest you get one ASAP before key evidence is destroyed.

Jef, I thought ambulance chasers were the dregs of the profession, but you've hit a new low.

OP: Jef is full of crap; you can represent yourself , if you so desire.

It's VERY unlikely your case will be thrown out.

Jef is an embarrassment to all attorneys.
If he was in the LEAST proficient in his profession, he wouldn't be trolling for customers here.
That's a lawyer no one wants to hire.

Jef is also violating attorney ethics laws in New Jersey. He may want to get in touch with the Committee on Attorney Advertising and have them explain the rules on attorney advertising to him before he ends up being censured. I'm pretty sure that his employer would also like to know about Jef's little advertising campaign.
