was wondering about first offense dui law. i was charged with dui but it was reduced with a lawyer to reckless driving and i was recently charged again with dui. so is the first offense meaning first time convicted or first time charged? Live in Ga btw

oh my lord. so you didn't learn the first time.

how long ago was the first charge and where were the terms of the of the charge reduction? are you on probation of any kind?

This is a question you should ask of your attorney.


With that said...good Lord, I hope you are charged as a second DUI - you OBVIOUSLY didn't learn your lesson the first time!

I suspect they will treat it as a first offense, but hit you with the upper end of the punishment where possible.

2nd offense is mandatory 48 hours in jail, up to one year. 1st offense is up to one year. I would expect at least a 48 hour sentence.

2nd offense fines are $600 to $1000. 1st are $300 to $1000. Don't expect anything under $600.

2nd offense license suspension is 18 to 36 months. 1st offense is UP TO 1 year. Expect a 1 year license suspension.

i was arrested the first time over a year ago July 2012 but didn't end up pleading till may of this year. and yes i am on probation

In that case you need to look into the penalties for violating your probation, assuming avoiding arrest was a condition of your probation.

dude. get yourself an attorney IMMEDIATELY!

this is a probation violation. ON TOP! please read your terms. some charge reductions are only done in agreement upon staying out of trouble.

even if i already plead guilty to the charges and the case has been settled they can un-plea me and bump the charges back up?

It depends. Was the original DUI charge dismissed or continued?

If continued, under the condition that you abide by the terms of your probation, you could be looking at the original DUI, a second DUI, as well as VOP.

You need an attorney.

98% sure charges were dismissed if i accepted the charge of reckless driving ,which i did
