Fixing a fence

I live in California and have a property line dispute with my neighbor. I recently moved in to a house and had the property surveyed. I found out that I had an additional 3 feet of property available to me. I talked with the neighbors and they verbally agreed to split the cost to erect a new fence at the surveyed property line. The neighbors then decided to not split the cost and told me to keep the fence at the current location.

Some of the questions that I have,

1. Do I have a right to enter his property, so that I can build a wall on my property?
2. Is there anything that I can do get him to split the cost of the new fence?
3. If I move the wall up to the surveyed property line can the neighbor do anything legally?
