Anyone familiar with Floridas Accident Reporting Privledge law - Case example below. Would this be a valid defense motion to supress identtity of the driver even if a criminal investigation followed? Thanks



Defendant was involved in a minor traffic accident. He was asked to complete roadside tests which he failed and blew .187 on the breath test. Result: Attorney XXXXXfiled a motion to suppress the identity of the defendant using the accident report privilege and a motion to suppress the .187 breath result based on a twenty minute violation. The state dismissed the case at trial.

There should be more paperwork than an 'accident report'.

No, it doesn't happen that way.
However, there are specific requirements police follow in their investigation and documentation of a DUI case.
In some circumstances, a case can be dismissed if the procedures were violated.
