Fleeing on warrant a felony?

What is the name of your state? IL

Someone I know has a pending warrant for his arrest in IL. This warrant has been active for 2 years. The warrant is for contempt of court for not appearing all the times he's been demanded to. He has since fled the state with his two children without his wife's permission or knowledge. This he did 1-1/2 yrs ago. He has not returned back to ILL. Is what he did considered a felony? He was also to appear in ILL divorce court last Dec and did not show for that either. His picture was all over the courtroom and the shariff's were all over the building looking for him. He's a flight risk, and has taken custody of these kids in PA. Is what he did by fleeing from a warrant a felony?

Depending on the status of the custody issue, he may have committed ADDITIONAL crimes (likely all felonies) by taking the children from the state and away from mom!

It is impossible for us to know what the warrant is for without seeing it. if he has a warrant for failing to appear in court, it could be a misdemeanor warrant unless the underlying charge is a felony. But if he fled the state WITH the kids and has not let mom have visitation, chances are his current custody will eventually be overruled as the court of jurisdiction in ILL will probably charge him with additional crimes.

If ILL plays hardball, he will find himself arrested in PA and the kids taken from him. He could be charged with child stealing (or whatever equivalent offenses there are out there) as well as POSSIBLE federal charges if appropriate.

The lout needs an attorney before this all comes crashing down around his head.

actually he's had the warrant active for appox 2 years and it is based on an unpaid bill that he's known about. He's been arresting on it many times and still have not paid it. He fled ILL, to PA with the kids, without mom knowing, after being in PA for 3 days calls mom/wife and says come here to live and we'll come back in June. MOm/wife goes (mistake), but then he gains legal residency for kids and claims custody based on lies against wife/mom. Has custody now. But still has that warrant alive in IL, and he does know about it. SO one thing doesnt have to do with the other but maybe in a round about way. Same man has the warrant, bad debts with bank, and foreclosure under his belt all in IL, PA knows nothing about any of it

Well, if the warrant is a felony, and ILL is willing to extradite, then he can go to jail for it. If it is a misdemeanor and/or ILL is NOT willing to extradite, then all the warrant may do is prevent him from getting government aid or a good job that requires an in depth background check.

Well his wife's attorney said it COULD be extriditable, but the person's attorneys office that placed the warrant said they wont do it as its not worth it to him. Well then why put the warrant out in the first place?hm

if a third person can give answers as to how I can get my children back and have this guy arrested..sure! :)
