My husband and I are currently going through a divorce. Nothing has been finalized-he hasn't even filed the papers yet. He informed me yesterday that he is taking our kids and moving to NY to be closer to his family. Can he do this if I haven't consented?

My response:

Then I would suggest that you file for your divorce IMMEDIATELY. Once filed and served on him, there is an automatic restraining order in effect, to keep both of you from taking kids, emptying bank accounts, selling vehicles, etc., etc.

If he takes them from you before he's personally served with the court papers, you'll be in for a world of hurt, and a more expensive divorce - - because you'll be fighting from two States.

He is now telling me that since I am the one that left the house that my chances of being able to see the kids for any kind of visitation right now are slim to none. I am hoping to speak with an attorney today.....but need to know if he can do this?
