What is the name of your state (only U.S. law)? Florida..

I have a question about Florida firearm law

FS 790.25 - Lawful ownership, possession, and use of firearms and other weapons. link-> Statutes & Constitution :View Statutes :->2007->Ch0790->Section 25

Specificly section
3 -(H) A person engaged in fishing, camping, or lawful hunting or going to or returning from a fishing, camping, or lawful hunting expedition;

Would you interpolate this statute to say that a person while fishing can carry a weapon concealed without a cc permit and or openly??

A beer is riding on the answer.

790.25 says you can carry in your car without license if it's securely cased or otherwise inaccessible (in the trunk, for example). You can't carry it concealed if you can get to it. If it is inaccessible, then the concealed carry laws don't apply there.

The other section you mention only gives relief from 790.53 (bars on open carry) and oddly the section on issuing concealed carry licenses. However it doesn't give relief from 790.01 which is the rule barring concealed carry.
In my opinion, you conceal carry outside of the limited circumstances in 790.25 without the license you're in trouble even if you are actively hunting.

Thank you for your reply flyingron,

Well we all agree that you can open carry a firearm while fishing,

I am under the interpretation that in 790.25 section 3 it specifically say that 790.053 and 790.06 do not apply while **************

790.06 ...... License to carry concealed weapon or firearm.
790.053 .... Open carrying of weapons.

The argument is, I believe you can conceal carry without a license while fishing. They say no you cant.

their argument is in section 2 of 790.25 it states

(2) USES NOT AUTHORIZED.--

(a) This section does not authorize carrying a concealed weapon without a permit, as prohibited by ss. 790.01 and 790.02.

My opponents argument is ....that since section 2 comes before 3 then you cannot conceal carry without a permit while fishing, hunting or camping.

Help

Woody,
