What is the name of your state (only U.S. law)? florida
my father is on his death bed from cancer and I was told by the doctors it's just a matter of days before he passes. my older sister (40) has pretty much taken control over his affairs by having him do and sign a will giving her control, having his car put in her name, and having him sign a power of attorney to have her sign control of his bank account. I believe he has life insurance and a 401k as he had worked for a major company for at least 10 years prior to getting sick. My sister has denied that he has any money or insurance and said she would have to figure out how to pay for his final expenses. I know she and her husband have a serious gambling problem and I want to be sure that this is handeled legally through a florida probate court. I believe it's the law in florida, by my sister has been known to avoid the law at times.
my question is how do i make sure this goes through probate and myself and my other sibbling are made aware of and partisipate in this matter.
thank you
