This is not an easy one......i very rarely see a partially illegal apartment.

I would think a judge might under the circumstances think that the 2nd bedroom was totally unusable due to no heat and it floods... Think of it this way close the bedroom door ...would anyone pay what you are paying for that 1 br apartment ...? if so then chances are that the second "illegal" bedroom would be considered a bonus room even though is barely usuable.

So its pretty much a judgment call.....is the apartment worth x dollars or is it worth xx dollars?

But if you are paying for a 2bedroom you are not getting full value for your money due to it being Illegal, then you shoud sue the landlord for a rent reduction, and rebate.

So call the city and make sure he gets lots of violations

djdj one last comment in regards to younglsm, I rented this property because I promised my child we would get a house with a yard a within a year of my promise. We rented a place in Chatsworth CA. (horse country. My first experience renting a house in CA. We are from Nebraska. I walked into the situation very gullible and a neighbor told me about this website, so that I might get practical legal advice for my situation. I never thought for one second that my ability as a mother would be judged just because I made some mistakes. I happen to believe that even though we make mistakes, there are people and statutes that cover us.(simply because there are people like us. As a senior, you might tell junior to put the sphincter on rotate. Junior got pretty excited with the abhorrent judgemental comments. Anyhow, I was seeking help. Mouthy demands that I can just pick up and leave. I am seriously asking you, how can I do that. I have not established credit in CA. How can I get the landlord to give me back my $2000.00 deposit so I can move? If it were possible to get it without a court battle, I really want to know. Do I have legal grounds to demand it now that the landlord is in default? It would be the only way I could move.

oops sorry that the ex has passed away....... and to be judgmental on your ability as a mother, but then you are the exception, most single parents have an ex, and are usually getting screwed.

Did the ex have any life insurance? or any money at all?

and what about the grandparents on his side, do they feel living in a crummy place is what you deserve, or what the grandkids deserve? or are they a bunch of flat broke rednecks too?

I guess what this boils down to is you must depend on family to help out in times of need, and to try and blame the landlord who is no relation to you is what i guess people find offensive.

Just like anything else, you want to break the lease you have to sue the landlord in small claims or civil court, and present your eveidence to a judge, and if the judge agrees
well you win,

A lease works both ways, a landlord cannot just evict you without penalties, and you cannot break a lease without penalties. So spend some time this week at your local courthouse and start asking questions about this, most of the people in small claims court or civil court will be helpful and finding and filling out the right forms..

This will be a great learning experience about a little known country called AMERICA!
