I live in Calif and I recently entered into a lease purchase option agreement with My uncle. Upon recording this at the co. recorders office I find out that a old friend of the family has sneaked his way onto 29% of this deed. This old friend of the family claims that he loaned or gave my uncle money enough to buy 29% of this property and pay taxes on his portion forever and he was unaware that the property still had a lien holder and a monthly note of $300.00per month so he is not entitled to pay anything ever again. My uncle has demtia and doesn't know anything. I have deeds which state that there are no transfer taxes due, meaning that there was no money exchanged as far as I see it. My question is do I have a criminal case, civil suit, small claims or harrassment? This guy is trying to get somthing for nothing that is what he does. He has no job and nothing to do but bother me. This property has been in the family since 1945 and I have 20 family members and neighbor who will testify on who's property this is or should be. They all know this guy and know he is up to know good.
