Exempt

Guest
Greetings,

I am a manager in a production company. When orders were low, we were notified that all employees were being reduce to 3/4 time, with a proportional cut in pay. I thought that as as manager, and "exempt" staff member, my salary could not be reduced when working fewer hours, since it is not increased when I work more than 40 hours a week. Was it legal for my employer to reduce my income, for approximately 3 months? Am I entitled to backpay for the difference?

Any information would be appreciated!

Absent an employment agreement or a union contract it is possible for the employer to fire you at will, or cut your pay to minimum wage, change hours, etc. Being an exempt employee only means you don't get overtime.
