Help, got call from attorney that check is in office for case. For 2 years thought case was going to trial. Injury is permanent and confirmed by both sides' specialists. Did they settle for without getting my approval, if so does this mean that they felt the offer was too good to refuse?

All indications say case proceeding toward trial and even had appointment for other side's specialist to examine again in 3 weeks?

Any insight as to why this happens would be greatly appreciated. I won't get much after the medical bills are paid but have lots of future liabilities due to the injury.

Nothing is settled till you sign for the check. My ex-lawyer told me and the Nevada Bar Association that sometime insurance companies will send a check hoping that the person will accept it because it's sitting right in front of them. Make sure that is the case and that your lawyer and the insurance company did not talk and "decide" on an amount. The best way to find out is take to the insurance person in charge of your claim and ask them straight out if they sent what they thought was reasonable or if a decision was made with the lawyer. Either way untill YOU and no one else accepts it the amount is not agreeded upon.

I'm going through this myself after I released my lawyer I'm now having to do it all myself. I just got finished sending copies of ALL my bills due to my accident (including the cost of a replacement car and the monies owed to my former attorney) to the insurance company. As I stated in one of my letters to the insurance company. This accident was not my fault but your clients and I should not end up in debt for something that was the fault of another party.
