a 5 day notice was given on sep. 7 2005, judge dismissed FD case 9/21/2005 without prejudice. another FD was filed again hearing 10/27/2005 dismissed improper 30 day notice without prejudice. judge accepted 5 day notice from prior filing 9/07/2005 as proper 5 day notice. doesnt landlord need to file a new 5 day notice for each FD filed?

that would depend on WHY the case was dismissed. for example, if the case was dismissed bcause the LL didn't wait for the 5 day notice to expire before going to court, then the LL can refile (at the proper time) and use the original 5 day notice as the basis.
