I am having a problem with my secound mortage company. I had been late on two months but not by more then three weeks and in each case I did pay the late fee. They are current at this time but they have send my account to their defaulf department and when I called to fine out why. I was told that they could not discuss anything with me and that I needed a attorney because they can pull the loan if you are late at all. My question is can they foreclose on my home when they are current on payments?My home is in the state of Florida. Do you have any suggest on what I can do to save my home? Also, I have noticed that they are not cashing my payments since sending the account to the default department. I do not have the means at this time to pay them off or secure another loan to pay them off. Please help if you can.

They can indeed foreclose so hire an attorney fast since there is more to this story than what you wrote.

There is not anymore to this that we know of. I did talk to an National equity company person about this problem and was told that this company was doing this to everyone and that there were hundreds of suits filed at this time on this company. I have contacted an attorney to look into this but have heard nothing so far. If anyone else out there is having problems with The Money Store please let me know.
