What is the name of your state?virginia.
Can a mortgage company foreclose without giving notice? I went on a repayment plan in June 2004 after the sent my loan to foreclosure. My payment were due on the 20th of each month. My Oct payment was sent late through Western Union quick collect on Nov. 22. So that was making me still owe for Nov. I am working away from home and when my mail from home ended up being forwarded to me, on Dec 16 there were two certified letters from a lawyers office stating that my home was to be auctioned off on Dec 17, the very next day that I received the letters. So that evening I called the lawyers office and left a message. Never got a call back. I called again on the 18 and they stated the house was sold and I should receive something in the mail. Still today I have received nothing. After talking to someone at the mortgage company, they said they returned my oct payment back to western union (It is in western union but I cant get it until I'm back in the Va area) Can they do this without sending me any notices? Now I'm hoping my belongings are in my house and no one has entered and removed them because still today, I have not received any letters from anyone else? Anything I can do? :confused:

I am a little unclear on how and why you did not receive notice.

You said you got letters and stuff and surely you knew you had defaulted on the loan.

Anyway, a lender must give you notice; I am not clear from reading your post how it is you think you did not get notice. Was it published in the newspaper in the county where it was foreclosed?

In June 2004, to avoid foreclosesure, I entered into a repayment plan with the mortgage co. so my monthly payment for the next 8 months, with all the extra fees, was double my usual monthly payments. I have been away from my home working an assignment in Florida since the end of November, so if it was posted in the newspaper , I was not there to see it. Since I started the repayment plan, the only mail I received was the letters from the lawyers ,that ended up being forwarded to me from my Va address, to here in Fl., on Dec 16, and they said the house was to be sold at auction on Dec. 17.

So you violated your repayment plan and got foreclosed upon.

Is that a fair statement of the facts?

Senior Judge,
you must be on the side of the mortgage companies because you never offer advice on situations, just criticisms. Just like most of the people you talk with when trying to talk to the people at the mortgage companies.

There is more to this story and it is not at all one sided as you tell it.

what default. It foreclosed now. Due to poor work around the town I live in, I have been working out of the state of Virginia, from NY to Fl. I was, and still is, away from my home for months at a time. What else could there be except for what I posted. Asking for advice.

He will not offer any useful advice. He is pompous and forms negative opinions of those who have had financial difficulties. Judging by his responses, he must be perfect. :rolleyes:

Its YOUR fault that they didnt pay their mortgage to begin with.
Its YOUR fault that when they set up a repayment plan, they didnt keep those terms either.
Its YOUR fault that they dont have work.
Its YOUR fault that they travel all across the country like gypsies.

Its YOUR fault that they're just total and complete losers, and homeless at that.

And to the OP, why on earth do you have to wait to go back home to get your money from Western Union? They are a worldwide company with literally thousands of agents. Go to an agent, show them your ID, and get your money.

Most situations would be so much simpler if people would just own up to their faults, you defaulted on your mortgage, they gave you a 2nd chance plan, you defaulted AGAIN! What did you expect them to do? Send you a new welcome mat for your front door and a bouquet of flowers? Get real, you messed up, now deal with it?
