my child is 14 yrs. old, on Oct. 11 he was suspended from school for fighting. Also on that day he was arrested by the school resource officer......claiming he disrupted school. Another child entered the classroom where my son was, this child didn't even belong in this class. The other child pushed my child to the floor, the teacher got between them, as my son got up from the floor he clenched his fist. The teacher as him to just leave the classroom, he did. The janitor was also in the classroom & volunteered to take them to the office. My son was taken directly to the resource officer, the other child to the vice principle (who was later to be sent back to class). My son was arrested, because he told the officer he didn't want to hear his speech about fighting, because he didn't, he never touched the other boy. But the officer says he threatened the other child by making a fist****************************.now remember my child was pushed to the floor first. The janitor makes a written statement that he saw the whole thing**************...& my child hit the other child in the face. The teacher says she didn't see when my son hit the floor, but when she heard him fall she turned around & saw everything else. But didn't think the other boy had been hit in the face, he didn't appear to have been. My child was suspended, then three days later we get a letter for recommendation of expulsion. NO hearing has ever been had on this matter****************************..we've ask about what we should do about my son's education, were told that they would send out a homebound teacher, didn't happen, we heard from the teacher that this took place in her classroom, she said she had ask to be his teacher when she saw he was up for homebound but would start after christmas holidays, my son, loving school, decided that he was tired of waiting, & after the holidays started at the alternative school. My question is now that the schoolboard has finally send a letter stating that my son is not expelled (delivered on Jan. 17), why can't he attend his school again & what recourse do we have in them admitting now that they just "dropped the ball" in getting him back in school? They totally forgot his case!
